What Benefits Does Georgia Provide Injured Workers?

Every day accidents happen on the job, leaving countless employees injured and unable to work any longer. When this happens, employers and their workers’ compensation insurance policies are meant to protect workers from the financial devastation of an injury. Workers’ compensation benefits exist for this very reason, though there are limitations depending on the specifics of your case as well as statewide restrictions in accordance with Georgia law.

Disability claims are often unfairly denied. For someone who truly needs these benefits to survive, a denial is upsetting and frightening. It is also extremely confusing and frustrating trying to figure out why your claim was denied and how you can get what you need. Our legal team at Whiteman, Hamilton & Conklin, LLC can present you with alternatives and options, including fighting the denial of your claim or maximizing your benefits if your claim has been accepted. But before we can help you, we need to discuss the details of your specific work injury. Call us today and one of our experienced workers’ compensation attorneys will give you a free, no obligation consultation.

The following are the main benefits offered for injured workers by the state of Georgia:

  • Medical benefits including all authorized treatment, physical therapy and medications
  • Temporary total or partial income replacement while injured worker is taken out of work or placed on restrictions by an authorized workers’ compensation doctor
  • Permanent partial disability benefit payments for the loss of functionality of the body part or parts injured, once maximum medical improvement has occurred

What Types of Benefits Are Available?

Temporary disability is offered for injured employees who are taken out of work by the workers’ compensation doctor for 7 days or more.  Weekly income benefits (TTD payments) are 2/3 of your “average weekly wage.” However, these benefits cap at a certain amount and you cannot exceed a maximum weekly amount under the law. Because these benefits are temporary, they will only last until you return to work, until the authorized workers’ comp. doctor states in writing that you are able to return to work without work restrictions, until the maximum number of weeks allowed by law, or until you (preferably through your workers’ comp. attorney) successfully negotiate settlement of your claim with the workers’ comp. insurance company.
